Terms and Conditions

Prices:
Unless specifically stated otherwise, ALL prices are quoted in Canadian dollars, based on F.O.B. Ewing’s plant, Whitby, Ontario and are firm for acceptance within thirty (30) days. Charges for transportation, and all applicable duties, tariffs, customs brokerage and taxes are extra.

Terms:
Net 30 days on approved credit. Initial orders may be subject to pre-paid or C.O.D. terms, until approved credit is established. Credit terms are granted at the sole discretion of Ewing and may be withdrawn without notice.

Shipments/Invoicing:
Ewing must ship product within ten (10) days of completion. Orders are invoiced on the date they are shipped, but, not later than ten (10) days after the they are ready for shipment. Shipments that are delayed, at the customer’s request, will be billed as though they shipped ten (10) days after completion, and may be subject to storage charges or the product may be redirected to fulfill other customers’ orders.

Storage of Products for Delayed Installations:
Product that is delivered but not installed immediately must be unwrapped (to prevent staining by wrap), inspected for any defects, damage, errors or omissions (see below) and then stored in a dry, secure, above ground location. Claims for damage to product must be made within 10 days of receipt of product (see below) and will not be considered without acceptable proof that these instructions were followed.

Inspection and Damage:
Materials, parts and product are inspected throughout the manufacturing process. All finished product is carefully inspected by Ewing prior to shipping.

Customers must inspect product when received.  Any defects, damage, errors or omissions must be reported to Ewing within 10 calendar days of receipt of product. Ewing is not responsible for loss or damage of product while in transit.  All claims for lost or damaged product while in transit must be filed directly with the carrier, by the purchaser, if shipped third party collect.  If orders were shipped prepaid, supporting documentation (emails, pictures, etc.) must be sent to Ewing within 5 calendar days so that Ewing can file a claim with the carrier.

Warranty:
All product is carefully inspected prior to shipping. Ewing warrants all product to be free from defect, in material and workmanship, for a period of one (1) year from date of shipment.  Upon proper notification of defect/damage/error/omission, Ewing will review the information received and once confirmed, will endeavor to repair or replace the defective/damage material or product, at Ewing’s option.  Charges for unauthorized repairs, performed by others, will not be paid/reimbursed by Ewing.

Returns:
Product will not be accepted for repair, replacement or credit without PRIOR WRITTEN AUTHORIZATION BY EWING. Once authorized, product must be returned TRANSPORTATION PREPAID. Product returned for credit is subject to a 20% restocking fee plus a refurbishing fee (if applicable), unless otherwise stated by Ewing in the written authorization for return.

Custom products are not refundable.

Delays Outside Ewing’s Control:
Ewing is not responsible for delays resulting from: material shortages, strikes, fire, accidents, carrier delays, and other causes beyond the control of Ewing. Ewing will make best effort to advise customers when such delays occur that impact their orders.

Anchor Bolts – Caution:
Anchor bolts are sized to suit the specific pole type.  Ewing recommends that an engineering professional be consulted for the design of concrete footings.

Title:
Title to products shall remain in the name of Ewing Flagpole and Traffic Products Co, Inc. and shall not pass to the purchaser, unless and until the FULL purchase price, as shown on the invoice(s) is paid.
